These Terms and Conditions (“Terms”) govern your use of the Tiny Castle Creations website and any purchase, custom order, quote request, embroidery service, or other transaction with Tiny Castle Creations LLC.

Tiny Castle Creations is operated by Tiny Castle Creations LLC, an Ohio limited liability company.

Throughout these Terms, “Tiny Castle Creations,” “TCC,” “we,” “us,” and “our” refer to Tiny Castle Creations LLC. “Customer,” “you,” and “your” refer to the person or organization using our website, requesting a quote, submitting an order, purchasing a product, or providing an item for embroidery.

All purchases, orders, quotes, and service agreements are entered into with Tiny Castle Creations LLC and not individually with any of its members, managers, employees, or authorized agents.

By using our website, submitting a quote request, approving an order or design, making a payment, or purchasing a product, you acknowledge that you have read, understood, and agree to these Terms.

1. Eligibility and Authority

You must be at least 18 years old and legally capable of entering into a binding agreement to place an order or request services from Tiny Castle Creations LLC.

When placing an order on behalf of a business, school, team, organization, employer, or another person, you represent that you are authorized to approve the order and bind that person or organization to these Terms.

2. Website Use

You may use our website only for lawful purposes.

You may not:

  • Attempt to gain unauthorized access to the website or its systems;
  • Interfere with the website’s operation or security;
  • Introduce viruses, malicious code, automated scraping tools, or other harmful technology;
  • Use the website to submit fraudulent, unlawful, infringing, threatening, or offensive content;
  • Impersonate another person or misrepresent your identity or authority;
  • Copy or commercially exploit website content without our written permission; or
  • Use the website in a manner that violates applicable law.

We may restrict or terminate access to the website when we reasonably believe these Terms have been violated.

3. Product Information and Availability

We make reasonable efforts to accurately describe and display our products and services. However:

  • Photographs and computer screens may display colors differently from actual fabric, thread, vinyl, or other materials;
  • Product measurements and dimensions may be approximate;
  • Blank apparel and other products may vary slightly between manufacturers, production runs, or suppliers;
  • Products, colors, sizes, materials, and styles are subject to availability; and
  • Minor variations associated with embroidery, handmade production, and material differences are not normally considered defects.

We reserve the right to correct errors in product descriptions, photographs, prices, availability, or other website content.

Placing an order does not guarantee that a product, color, size, or material is available. If an item becomes unavailable, we may offer a comparable substitute for your approval, revise the order, cancel the affected item, or issue a refund for the affected portion of the order.

4. Quotes and Order Acceptance

A quote request is a request for information and does not create a binding order.

Unless otherwise stated, a quote is based on the information available when it is prepared. A quote may change if the quantity, artwork, garment, materials, placement, design complexity, deadline, or other order requirements change.

An order is accepted only when Tiny Castle Creations LLC confirms the order and any required approval, deposit, or payment has been received.

We reserve the right to decline or cancel an order before production begins, including when:

  • The requested product or material is unavailable;
  • The supplied artwork is unusable or unauthorized;
  • The requested deadline cannot reasonably be met;
  • The item is unsuitable for embroidery;
  • The order contains an obvious pricing, calculation, or website error;
  • The request is unlawful, threatening, discriminatory, infringing, or otherwise inappropriate;
  • The customer has failed to provide required information or payment; or
  • We reasonably believe the transaction is fraudulent or presents an unreasonable risk.

If we cancel an accepted order before performing chargeable work, we will refund amounts paid for work or products that will not be provided.

5. Custom and Personalized Orders

Customers are responsible for reviewing and approving all order information before production begins.

This information may include:

  • Names, spelling, dates, numbers, and wording;
  • Monograms and the intended order of initials;
  • Design selection and artwork;
  • Thread, garment, and material colors;
  • Garment style and size;
  • Embroidery dimensions and placement;
  • Quantities; and
  • Logos or other customer-submitted information.

Tiny Castle Creations LLC is not responsible for errors contained in information, instructions, artwork, or proofs supplied or approved by the customer.

Once an order has been approved, requested changes may require additional design work, materials, labor, or production time. Changes may be subject to additional charges and may affect the estimated completion date.

Approval of a digital proof confirms the design’s general content, spelling, proportions, colors, and placement. A digital proof is a visual approximation and does not guarantee that thread, fabric, dimensions, or placement will appear exactly the same on the finished product.

We may make minor technical adjustments reasonably necessary to embroider or produce an approved design. These adjustments may include changes to stitch type, density, underlay, spacing, dimensions, or placement.

6. Customer-Supplied Artwork, Designs, and Logos

By supplying artwork, photographs, logos, trademarks, names, text, or other material, you represent that:

  • You own the material or have permission to use and reproduce it;
  • You have authority to authorize Tiny Castle Creations LLC to reproduce it;
  • Our use of the material to complete your order will not violate another person’s copyright, trademark, privacy, publicity, or other legal rights; and
  • The material does not contain unlawful or prohibited content.

You grant Tiny Castle Creations LLC a limited, nonexclusive license to reproduce, modify, digitize, resize, and use the submitted material as reasonably necessary to prepare, produce, document, and fulfill your order.

Tiny Castle Creations LLC does not independently verify ownership of every design submitted by a customer and is not responsible for ownership disputes arising from customer-supplied materials.

To the fullest extent permitted by law, you agree to defend, reimburse, indemnify, and hold harmless Tiny Castle Creations LLC and its members, managers, employees, and authorized agents from third-party claims, losses, liabilities, damages, and reasonable expenses resulting from your unauthorized submission or use of protected artwork, logos, trademarks, photographs, wording, or designs.

We may refuse to reproduce any material when we believe authorization is insufficient or the requested use may violate another party’s rights.

7. Digitizing and Design Files

Embroidery digitizing is the process of converting artwork into machine-readable stitching instructions.

Digitized embroidery files may differ from the original artwork because designs must be adapted for thread, fabric, stitch direction, density, size, and equipment limitations.

Unless otherwise agreed in writing:

  • Digitizing charges compensate Tiny Castle Creations LLC for preparing the embroidery design;
  • Payment of a digitizing charge does not transfer ownership of our working files, embroidery files, production methods, or technical settings;
  • Tiny Castle Creations LLC retains ownership of digitized embroidery files created by us; and
  • Customers receive the completed embroidered product rather than the underlying production file.

We may retain order records and digitized files for possible future use, but we do not guarantee that a file will be stored permanently or remain compatible with future equipment or software.

8. Customer-Provided Items

Tiny Castle Creations LLC may agree to embroider an item supplied by the customer.

Acceptance is subject to our inspection and approval. We may decline an item that we believe is:

  • Fragile;
  • Unsuitable for embroidery;
  • Unusually valuable;
  • Irreplaceable;
  • Sentimental or collectible;
  • Contaminated or unsanitary;
  • Difficult to hoop or secure; or
  • Likely to be damaged during production.

Before we accept or perform work on a customer-provided item, the customer must agree to our Customer-Supplied Item Acknowledgment and Release.

Embroidery involves needles, machinery, hooping, clamping, adhesives, stabilizers, heat, pressure, marking, and handling. These processes carry an inherent risk of punctures, tears, stains, discoloration, scorching, distortion, equipment marks, loss, or complete destruction of the item.

By providing an item to Tiny Castle Creations LLC, the customer voluntarily accepts and assumes these risks.

To the fullest extent permitted by law, Tiny Castle Creations LLC and its members, managers, employees, and authorized agents are not responsible for replacing the item, reimbursing its value, or paying for sentimental, collectible, consequential, incidental, or other indirect loss associated with the item.

Any remedy or customer-service accommodation involving a customer-provided item will be governed by:

  • These Terms;
  • Our Pickup, Returns and Refunds Policy;
  • The separately accepted Customer-Supplied Item Acknowledgment and Release; and
  • Applicable law.

9. Pricing, Taxes, Deposits, and Payment

Prices are stated in United States dollars unless otherwise indicated.

Applicable taxes, shipping charges, special-order costs, rush charges, artwork charges, digitizing fees, setup charges, and other order-specific charges may be added to the stated price or quote.

Any required deposit, payment schedule, or remaining balance will be identified in the applicable quote, invoice, order confirmation, or checkout page.

We may require full or partial payment before:

  • Ordering products or materials;
  • Beginning digitizing or design work;
  • Reserving production time; or
  • Beginning production.

Failure to make a required payment may result in the order being placed on hold or canceled.

Tiny Castle Creations LLC may retain possession of completed products until the outstanding balance has been paid, to the extent permitted by law.

If a price is obviously incorrect because of a website, typographical, calculation, or technical error, we may correct the price before accepting or fulfilling the order. If payment has already been collected, the customer may approve the corrected price or receive a refund for the canceled item.

10. Production Times and Deadlines

Any production, completion, pickup, shipping, or delivery date is an estimate unless Tiny Castle Creations LLC expressly agrees in writing to a guaranteed deadline.

Production estimates generally begin after:

  • The order has been accepted;
  • All necessary information and usable artwork have been received;
  • The customer has approved the design and order details;
  • Required products and materials are available; and
  • Any required deposit or payment has been received.

Customer delays in supplying information, approving proofs, providing suitable items, or making payment may extend the estimated completion date.

Customers should tell us about event dates or other deadlines before approving an order. Informing us of a deadline does not guarantee that it can be met unless we expressly accept the deadline in writing.

Tiny Castle Creations LLC is not responsible for delays caused by supplier shortages, carrier delays, equipment failure, power or internet outages, severe weather, illness, emergencies, labor disruptions, government actions, or other circumstances reasonably outside our control.

11. Local Pickup

Unless Tiny Castle Creations LLC expressly agrees to another arrangement, completed orders must be picked up locally by appointment.

We will contact the customer when the order is ready and provide available pickup instructions. Customers should not arrive without a confirmed pickup appointment.

Customers are encouraged to inspect their order at pickup whenever reasonably possible.

Responsibility for the order transfers to the customer when the order is picked up by the customer or by another person authorized by the customer.

The customer is responsible for ensuring that any person sent to pick up an order has authority to receive it.

12. Shipping and Delivery

Tiny Castle Creations LLC does not offer routine shipping or delivery unless we expressly agree to it in a quote, invoice, order confirmation, or other written communication.

When shipping is expressly approved:

  • The customer is responsible for providing a complete and accurate delivery address;
  • Additional shipping, insurance, packaging, signature, or handling charges may apply;
  • Delivery dates provided by a carrier are estimates and are not guaranteed by Tiny Castle Creations LLC;
  • The customer must promptly report packages that arrive damaged, incomplete, or incorrectly addressed;
  • The customer may be required to retain packaging and cooperate with any carrier claim;
  • Tiny Castle Creations LLC is not responsible for delays caused by the carrier or circumstances outside our reasonable control; and
  • Risk of loss transfers as permitted by applicable law and the applicable shipping arrangement.

If an order cannot be shipped within a promised shipping period, we will provide any delay notice, cancellation option, or refund required by applicable law.

Any order-specific written shipping agreement will control over this section to the extent of a conflict.

13. Cancellations

Because custom orders may require consultation, design preparation, digitizing, special-order materials, and reserved production time, orders cannot be canceled once materials have been purchased, artwork has been digitized, or production has begun.

A cancellation approved before that point may be subject to deductions for:

  • Completed design or consultation work;
  • Digitizing charges;
  • Materials already ordered or purchased;
  • Nonreturnable or special-order products;
  • Payment-processing costs where legally permitted; and
  • Other documented expenses already incurred for the order.

Any refund due following an approved cancellation will be determined under our Pickup, Returns and Refunds Policy and applicable law.

14. Returns, Exchanges, Refunds, and Order Problems

Our Pickup, Returns and Refunds Policy, as published on our website, is incorporated into these Terms.

Custom, personalized, monogrammed, embroidered, and made-to-order products are final sale except when otherwise required by law or when Tiny Castle Creations LLC determines that we made a material production error.

Customers must report alleged errors or workmanship problems within seven calendar days after pickup or receipt.

The customer must provide:

  • Photographs of the product and the reported problem;
  • A description of the issue;
  • The customer’s name or order information; and
  • Any other information reasonably requested to evaluate the claim.

The product must not have been worn, washed, altered, misused, or damaged after pickup or delivery.

Tiny Castle Creations LLC will determine whether a reported issue resulted from:

  • A material error by Tiny Castle Creations LLC;
  • Incorrect information, instructions, artwork, or approval supplied by the customer;
  • A defect in the blank product or customer-provided item;
  • A normal or reasonable characteristic of embroidery;
  • Improper care, storage, or use; or
  • Damage occurring after completion, pickup, or delivery.

Available remedies and exclusions are described in our Pickup, Returns and Refunds Policy.

Nothing in these Terms eliminates a consumer right or remedy that cannot legally be waived.

15. Remedies for Verified Errors

When Tiny Castle Creations LLC determines that we made a material production error, we may, at our discretion and as permitted by applicable law:

  • Correct the product;
  • Reproduce the affected item;
  • Replace the affected product with the same or a reasonably comparable item;
  • Issue store credit;
  • Issue a partial refund;
  • Issue a refund of the amount paid for the affected product or service; or
  • Provide another mutually agreed resolution.

The appropriate remedy will depend on the nature of the error, the product involved, material availability, and whether correction or replacement is reasonably possible.

Except where prohibited by law, Tiny Castle Creations LLC is not responsible for replacement costs that exceed the amount paid to us for the affected product or service.

16. Product Care and Use

Customers are responsible for reviewing and following all care instructions associated with the garment, material, thread, decoration, or finished product.

Tiny Castle Creations LLC is not responsible for damage caused by:

  • Improper washing or drying;
  • Bleach, stain treatments, harsh chemicals, or excessive heat;
  • Ironing directly over embroidery or decoration;
  • Normal wear and tear;
  • Improper storage;
  • Alterations performed by another person;
  • Misuse or use for an unintended purpose; or
  • Failure to follow applicable care instructions.

Products that have been worn, washed, altered, or damaged after pickup or delivery may not qualify for a correction, replacement, refund, or other remedy.

17. Handmade and Embroidery Variations

Embroidery is a mechanical and partly handmade production process.

Minor variations may occur between items, including variations in:

  • Stitching;
  • Placement;
  • Thread color;
  • Design dimensions;
  • Fabric tension;
  • Alignment;
  • Texture;
  • Puckering;
  • Material response; and
  • Finished appearance.

Small differences that do not materially change the approved design or normal use of the product are not considered defects.

Items with seams, pockets, zippers, linings, curves, existing decoration, or unusual construction may require placement or sizing adjustments.

18. Electronic Communications and Approvals

By placing an order or submitting a request electronically, you consent to receive order-related communications by email, telephone, or text message using the contact information you provide.

These communications may include:

  • Quote information;
  • Proof approvals;
  • Payment notices;
  • Production updates;
  • Pickup arrangements;
  • Shipping notices; and
  • Questions necessary to complete the order.

You are responsible for ensuring that your contact information is accurate and for reviewing messages concerning your order.

An electronic approval, checkbox acceptance, typed name, email confirmation, text-message confirmation, payment, or similar electronic action may serve as your acceptance of an order, proof, release, policy, or agreement where permitted by law.

19. Privacy

Our collection and use of personal information are governed by our Privacy Policy.

Payment information may be processed by independent third-party payment providers. Tiny Castle Creations LLC does not control the independent privacy, security, or data-handling practices of those providers.

20. Intellectual Property

Unless otherwise stated, the Tiny Castle Creations website and its original content—including text, graphics, photographs, logos, page designs, product descriptions, original artwork, and digitized designs—are owned by or licensed to Tiny Castle Creations LLC and are protected by applicable intellectual-property laws.

You may view and use the website for personal shopping and informational purposes.

You may not reproduce, distribute, modify, sell, publish, or commercially exploit our website content without written permission from Tiny Castle Creations LLC.

Customer-owned trademarks and submitted designs remain the property of their respective owners.

Displaying or photographing an example of completed work does not transfer ownership of a customer’s trademark or protected material to Tiny Castle Creations LLC.

21. Photographs and Portfolio Use

Unless the customer requests otherwise in writing before the order is completed, Tiny Castle Creations LLC may photograph completed products and use those photographs for our website, portfolio, social-media pages, product samples, advertising, or promotional materials.

We will make reasonable efforts not to publicly display private customer information, personal contact information, or other sensitive information.

Customers may request that an order not be photographed or publicly displayed by notifying us in writing before production is completed.

This section does not grant Tiny Castle Creations LLC ownership of a customer’s trademark, logo, photograph, or other protected material.

22. Third-Party Products, Services, and Links

Our website may contain links to third-party websites or may use services provided by payment processors, hosting providers, suppliers, social-media platforms, carriers, or other businesses.

Tiny Castle Creations LLC does not control and is not responsible for the content, availability, privacy practices, security, representations, or independent conduct of third-party services.

References or links to third parties do not constitute an endorsement, guarantee, or warranty.

23. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE, WEBSITE CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TINY CASTLE CREATIONS LLC DOES NOT GUARANTEE THAT THE WEBSITE WILL ALWAYS BE AVAILABLE, SECURE, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

EXCEPT FOR EXPRESS PROMISES CONTAINED IN AN ACCEPTED ORDER OR AS OTHERWISE REQUIRED BY LAW, TINY CASTLE CREATIONS LLC DISCLAIMS IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT SUCH WARRANTIES MAY LEGALLY BE DISCLAIMED.

ANY WARRANTY OR CONSUMER PROTECTION THAT CANNOT LEGALLY BE DISCLAIMED REMAINS IN EFFECT.

24. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TINY CASTLE CREATIONS LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AUTHORIZED AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES.

THIS INCLUDES, WITHOUT LIMITATION:

  • Lost profits or business opportunities;
  • Lost revenue;
  • Loss of use;
  • Missed events or deadlines;
  • Travel or transportation expenses;
  • Sentimental or collectible loss;
  • Damage to reputation;
  • Replacement value exceeding the amount paid to Tiny Castle Creations LLC; or
  • Other indirect or consequential loss.

Except for liability that cannot legally be limited, the total liability of Tiny Castle Creations LLC arising from a product, service, transaction, or order will not exceed the amount the customer paid to Tiny Castle Creations LLC for the specific product or service giving rise to the claim.

For customer-provided items, the separately accepted Customer-Supplied Item Acknowledgment and Release and the Pickup, Returns and Refunds Policy also apply.

These limitations do not apply to liability that cannot legally be excluded or limited, including liability arising from willful misconduct or other conduct for which limitation is prohibited by law.

25. No Personal Liability of LLC Representatives

All obligations arising from an order, purchase, quote, service, or use of this website are obligations of Tiny Castle Creations LLC.

To the fullest extent permitted by law, no member, manager, employee, or authorized agent of Tiny Castle Creations LLC will be personally liable for the debts, contractual obligations, or liabilities of Tiny Castle Creations LLC solely because of that person’s ownership, position, employment, or work on behalf of the company.

Nothing in this section excludes personal liability that cannot legally be limited or excluded.

26. Customer Responsibility and Indemnification

You are responsible for losses resulting from:

  • Your unlawful use of our website;
  • Your unauthorized submission of protected content;
  • False or misleading information supplied by you;
  • Your misuse of a completed product; or
  • Your material violation of these Terms.

To the fullest extent permitted by law, you agree to defend, reimburse, indemnify, and hold harmless Tiny Castle Creations LLC and its members, managers, employees, and authorized agents from third-party claims arising directly from:

  • Artwork, logos, trademarks, photographs, wording, or other content you supplied without authorization;
  • False statements concerning your ownership or authority;
  • Your unlawful use of the website or finished products; or
  • Your material violation of these Terms.

This section does not require you to reimburse Tiny Castle Creations LLC or another person for losses caused solely by that party’s own conduct where such reimbursement is prohibited by law.

27. Events Outside Our Control

Tiny Castle Creations LLC is not responsible for a failure or delay caused by circumstances reasonably outside our control.

Such circumstances may include:

  • Severe weather;
  • Fire, flood, or natural disaster;
  • Public emergency;
  • Illness or injury;
  • Power or internet failure;
  • Equipment breakdown;
  • Supplier shortage;
  • Material discontinuation;
  • Carrier disruption;
  • Labor dispute;
  • Governmental action; or
  • Another force majeure event.

When such an event affects an order, we may extend the estimated completion date, offer substitute materials for approval, partially fulfill the order, or cancel and refund the affected portion.

28. Governing Law and Disputes

These Terms and transactions with Tiny Castle Creations LLC are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except where another law must apply and cannot legally be waived.

Before filing a formal claim, the customer and Tiny Castle Creations LLC agree to make a reasonable, good-faith effort to resolve the dispute directly.

Unless applicable law requires otherwise, any lawsuit arising from these Terms or a transaction with Tiny Castle Creations LLC must be brought in a state or federal court with jurisdiction in Hamilton County, Ohio.

Nothing in this section prevents either party from bringing an eligible claim in small-claims court.

29. Statutory Consumer Rights

Certain transactions may be subject to cancellation, disclosure, refund, delivery, warranty, or other consumer protections under federal, state, or local law.

Nothing in these Terms is intended to waive or restrict a right or remedy that cannot legally be waived.

Where these Terms conflict with a mandatory consumer-protection law, the mandatory law will control only to the extent of the conflict.

30. Relationship Between Documents

These Terms should be read together with:

  • The applicable quote, invoice, or order confirmation;
  • Any approved proof or design;
  • The Pickup, Returns and Refunds Policy;
  • The Privacy Policy;
  • The Customer-Supplied Item Acknowledgment and Release, when applicable; and
  • Any other written agreement specifically associated with the order.

If these documents conflict:

  1. A separately signed or expressly accepted order-specific agreement will control for that order.
  2. The accepted quote, invoice, or order confirmation will control regarding order-specific pricing, quantity, products, and deadlines.
  3. The Customer-Supplied Item Acknowledgment and Release will control regarding risks associated with customer-provided items.
  4. The Pickup, Returns and Refunds Policy will control regarding returns, order problems, refunds, and remedies.
  5. These Terms will control regarding general website and transaction matters.

31. Changes to These Terms

Tiny Castle Creations LLC may update these Terms periodically.

Revised Terms will be posted on our website with a new effective date.

Changes apply prospectively and will not materially alter an already accepted order unless:

  • The customer agrees;
  • The change benefits the customer; or
  • The change is required by law.

Continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms for future website use and transactions.

32. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will remain in effect.

33. Waiver

The failure of Tiny Castle Creations LLC to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision or another provision later.

A waiver is effective only when made in writing by an authorized representative of Tiny Castle Creations LLC.

34. Assignment

You may not transfer an order or your rights or obligations under these Terms without our written consent.

Tiny Castle Creations LLC may transfer its rights and obligations as part of a sale, reorganization, merger, financing, or transfer of the business, subject to applicable law.

35. Entire Agreement

These Terms, together with the applicable documents identified above, constitute the complete agreement between the customer and Tiny Castle Creations LLC concerning the website and the applicable transaction.

They replace prior discussions or communications concerning the same subject, except for representations expressly included in an accepted order or separately signed written agreement.
